Breaking News: Kerekes won't testify in Cuadra homicide trial

Harlow Cuadra's former lover and co-defendant Joseph Kerekes took the stand this morning in Cuadra's capital homicide trial, but the 35-year-old Kerekes didn't testify.

After answering several brief questions from Cuadra Attorney Joseph D'Andrea, Kerekes said he wouldn't testify on Cuadra's behalf.

"I've been thinking a lot about my parents and it would destroy them if I said something that I didn't do," Kerekes said.

Kerekes, 35, pleaded guilty to second degree homicide in December and is serving a life-sentence. In his plea he said Cuadra had killed Bryan Kocis and then set fire to his Dallas Township home.

Cuadra's mother seated in the courtroom, shouted at Kerekes as he left the courtroom.

Cuadra started testifying after Kerekes stepped down.

Cuadra could face the death penalty if found guilty of first-degree homicide for Bryan Kocis' death in January 2007. Prosecutors allege Cuadra killed Kocis, 44, in order to lure an actor to the gay pornography he co-owned with Kerekes.

Kerekes was the second defense witness called this morning. Testimony started more than an hour late because of several legal issues that had to be addressed prior to Kerekes' testimony.
Update: "...Kerekes said. "What I told you (D'Andrea) is untrue." HOLY CRAP! Harlow is toast...simple as that, folks...I don't see WHAT he could possibly say on the stand now to undo this damage...the jury is not stupid, I'm sure they figured out what just happened...developing...

Update 2: Yeah, I'd be weeping too at this point...

"Cuadra is currently testifying on his behalf, recalling his childhood in Florida and enlisting in the U.S. Navy when he was 17 years old. He is weeping on the stand."
Update 3: We kinda saw this one comin'...

Update 4: The Cuadra Family Secret is trotted out...

"Cuadra's attorney Paul Walker is questioning Cuadra. Much of the testimony has focused on how Cuadra met Kerekes and how he was molested as a child by his step-father. Cuadra said he stopped talking to his family after he left the Navy.

He couldn't reveal to his family his homosexuality, or what his stepfather did, he said.

A weeping Cuadra apologized to his mother, who was also crying

"I'm sorry, Momma," Cuadra sobbed."
Update 5: From PC's blog: "12:31 PM: WNEP TV-16 reports that It turned out to be a bizarre morning in the murder trial of Harlow Cuadra..." Gee, ya think?

Update 6: LOL! This is what Harlow's defense has been reduced to: "During dinner, in which, Cuadra said Roy and Kerekes talked about filming movies together, Cuadra said he and Lockhart were "playing footsies" under the table."

Update 7: The Plan C Express leaves the station! Looks a lot like the Plan B Express, but w/o Joe on board.

Update 8: BTW there WAS a third witness so far today (if you count Joe, LOL!) and it was originally a typo; he was indeed a "defense" witness. Although what good he did for Harlow is far from clear at this point: "The defense's other witness, James Quare, 24, testified he met Kocis online and stopped by the Dallas Township home for a sexual rendezvous."

Update 10: LOL! from PC's blog: "11:48 AM: Sources tell me that Joe had $300 deposited in to his canteen (so that he could buy a TV), in order for him to agree to testify... looks like the defense lost that money."

Jim, spaghetti western endings aside, this will get much more exciting before it is over. It is getting a lot harder to keep quiet for me these days what with all the crazy crap that has happened in the courtroom. Do not be fooled by Joe's statement on the stand today. Consider the source...and while you're all thinking back through things, remember who wrote and signed the emails sent from boybatter...Joe/Mark/Trent not Harlow.....and also, since Joe did not have a trial, we don't know if there was forensic evidence linking Joe to the scene, we know there was no forensic evidence linking Harlow to the scene.

All good points Sassy, BUT...Joe was just hastily escorted out of the courtroom.

Meaning, the opportunity to point out those excellent points to the jury, by defense asking to have Joe treated as hostile, and then giving him the 3rd degree...just walked out the door.

Ah yes Jim, you do have a point. However, we all know and I am sure the attorneys do as well what a loose cannon Joe is. Hostile witness or not, by the time he opened and shut his mouth he could have potentially ruined the defense; the prosecution was smart not to call him for their side, he could have easily been asked to say Harlow killed Bryan, but he was too big a risk. Unfortunately, not everyone in the blogger community has had the pleasure of conversing with that nut case. In one conversation lasting 7 to 10 minutes, you can experience a plethora of personalities, stories, and threats. I think if Renee gets back on the stand, some of this will be explained in more detail.

Honestly, I just don't think it matters that much to the jury at this point, who controlled the email accounts and the credit cards.

The jury is going to ask themselves one question: Is there any way Joe killed Bryan alone, and that Harlow was *completely* ignorant and uninvolved?

All else, as they say, is smoke, mirrors and bullshit.

Funny I knew that was going to happen. Now Renee is back and what does she have to say this time.

What is funny is that she only testified for 30 minutes for the prosecution.

This really sounds like mitigation testimony, and I hope the prosecution objected vehemently. I don't think it should have been allowed.

Harlow is garnering sympathy. Remember the battered significant other defense? Harlow is laying the background of his being a victim, complete with waterworks and asides to Mama Cuadra.

Then, he will try to paint Joe as a dominating bully while sidestepping being in a time warp--19 years old--for 6 years.

Should be enligtening.

That goes totally against how they were trying to portray Bryan Kocis.

The other thing that I find strange is that Bryan's father said that he did not know that his son produced pornography.

Where was he when his son was arrested? The porn business was his defense. What is up with Papa Kocis, did he lie an the witness stand?

Again, wow, I didn't see this coming, but i don't enough of the background, but it is impressive that Joe seeks to protect his parents' memory of him by not lying to save Cuadra (sarcasm).

In trials, when it happens and it is good, the light is gray, tense, and then when it breaks your way, the light is less harsh, there's actually better light, not too bright, u cannot believe the relief, and u sit back and roll with it.

In this case, you get tunnel vision, the light either hums or blinds you, and each minute is an hour, it's incredibly hard to process what's just happened. You're just in shock, disbelief, heart pounding. And then ur faced with what to do, processing the moment, the jury, trying to find the right balance. but there is none, ur screwed.

I'm not there, but this is my take, the lawyer was afraid that Joe would add details proving harlow did it, and he just wanted him off. that's why no attack.

presumably Joe is getting his digs in, he obviously didn't tell the defense this testimony; Harlow has the remainder of his life in solitary to relive this moment.

What a friggin Perry Mason moment, that snarky DA on Perry Mason, the witness on the stand; and I don't think there were immediate gasps, it was just too big a moment to sink in...one of those things that leave you speechless.

who on here is doing the book; my favorite true crime book is "At Mother's Request", but this one has all the makings of one to top it.

Zach, I think you're exactly right, but after a disaster of this magnitude, this was NO time for the defense to be playing it safe.

Joe seems to have come across as *human* in this whole courtroom moment, exactly what the defense is NOT trying to portray.

i agree, it's lost, but the only downside was that he knew details that would prove he was telling the truth.
my gut, take a break, and then go in and attack, attack but what r u going to prove?
all that's left, Harlow's story, being dominated, etc., and this is another example of Joe's evil?

This is where that letter, the Plan comes in, you can't show anything good, misunderstood, or otherwise positive about Harlow, it's just a story. That phrase, tell a story, look good, no blue, black or charcoal suits, it bites him in the butt every time, there's no way around it. the jury will not be made fools, whatever the truth.
that's why to me, Renee was the most damning witness overall, sure the evidence sunk him, but he still could have been likable.

I forgot, 3 times i've seen this, where the only defense is that the son of bitch who was killed "needed killing"; that famous question, "Did he need killing?"
The last time i heard it was in the mid-80s, but in each case, the defendant was somewhat credible, likable, and the victim scum.
Here, they all appear to be cut from the same cloth.

I mean, they had all these CREDIBLE witnesses they could have used to make their "domination" point. Pastor Ron from the Out article. Any number of witnesses from the Fannick hearing: "Harlow won't roll on me!" Actual escort clients who Joe left a bad impression on (I know there were many).

So, who does the defense call instead? Liars and criminals. All chronic, easily provable habitual liars, and people with criminal records. Except for maybe the Chaplain, but what can he say?

i mean, Joe just sank him, what happened to all those memories of champagne and driving back and forth to Penn, the meal at La Cirque, tossing the football on the beach with dirty feet in the sand, sharing intimate details at dinner with Brent, Brent's tear in the butt...
being serious, i frankly thought Joe did the actual slitting of the throat, but equally culpable. the other stab wounds, i thought was prob done by harlow.

Exactly Jim, Harlow needs not say "I'm sorry" to mom or anyone else until he has blurted out, ok, ok, I was there, I was more than there, I was, I was, I was......... tons of more crying, and then Harlow says it was crazy and I was out of control, and it was like someone else was telling me what to do...... before being led off that stand.

But I'm sorry mom, and btw I had a rough life, big family bummers, but Joe did it.

To take a contrarian view for a moment, I really don't think Joe's turnabout on the stand will be all that important in the end. The jury realizes it was totally self-serving, he doesn't EVER want to say under oath that he played a role in the actual killing, he's still hoping for some miracle down the road like a pardon when he'll be set free.

Even if Joe had followed through and said "I did it, he had nothing to do with it," the jury wouldn't have believed him, and he would have been torn to shreds on cross with his plea statement.

The jury will hopefully just discount all this "He did it" "No he did it" nonsense from the both of these cowardly liars, they are both just as culpable under the law. It may have been a memorable moment for all of us, but I don't think it will play much of a role in the jury deliberations.

No no, you are being too hard on yourself. Harlow was sunk long before this latest Joe spectacle on the stand. This is all a sideshow, and has nothing to do with guilt or innocense.

If you had been flowing this case for a while you would see where it all unraveled for Harlow and Joe. It was in Vegas.

And I have wondered why people think Joe would have been there to add stabs to a already dead corpse? That would have been weird. Harlow did the deed, and his man came around to load up the goodies and start the BBQ with him.

There is not need for Joe to be placed stabbing an already dead body now is there? That would be just satanic or something.

A pardon? Oh, I think that's a bit of a stretch, Will. And I certainly don't see the jury making that kind of speculative leap towards "sef-serving" either.

No, the jury is gonna consider that Joe's got his life sentence, no matter what he said there on the stand.

Now, based on what WE bloggers know about Joe, yeah a case can be made, as Sassy says, he's lying.

But if so...what a lie!

And that's the whole point...the jury certainly does NOT know Joe as we do.

And THATS why I think it was a mistake for the defense to just shoo him off the stand like that, when things did not go according to the script.

D'Andrea made a crucial mistake, I am sure the prison visit to Joe convinced him that Joe would say something that would help.

Instead folks what we witnessed from Joe was the classic last grift.

And I was the one that said, no way Joe is going to take the stand. Well, looks like I was only half right. But same difference, he bolted on his lover for the final time.

I think this is playing out in a way that the facts are forcing it to. The facts required Harlow to get up there and say something to the jury. And the facts prevented Harlow from saying "look, there is a big misunderstanding here, I can explain. I was with a client, I never harmed that poor man, (no I take that back) I smelled smoke, and I saw a body and heard someone upstairs, etc.

I think D'Andrea needed to try something here - anything. I think it was a gamble with little chance of payoff, but what the hell, the trial has not gone well for his team.

And pehaps Joe is telling the truth that Harlow did it, and he is not taking that rap just to save Harlow when it would kill both his parents to see him as a killer when (now they see him as) he was only a planner and helper.

So I don't see this as a final Joe grift, as much as saying it was a fun ride Harlow and we've for sure reached the end of the line now.

Harlow needed this badly, as he has remained standing by his man. And now he knows he it truly alone. He should have figured this out before Vegas.

It was just a wake-up call that was long over due. Joe got tired of the lies, and thought for onece about his parents.

The murder itself was extremely brutal in the method used. Typically crimes carried out in this manner are brutal and personal in nature. When no personal link is established between victim and killer the question arises about the personality of the killer and why they would complete murder in such a brutal fashion.

I think that by bringing up the rape by his stepfather, Harlow just created the personal link between him and Kocis. Which would explain the brutality.

As Harlow said on the beach, it seemed like he got "revenge" for that rape.

I'm certain Melnick will not fail to make that point during his closing arguments.

You think Melnick wants to remind the jury that there is a "good" excuse for this brutal murder?

Perhaps he will read every line of the tape where Harlow admits being there, but I would guess play down the revenge part. Or maybe not.

I guess Harlow is on the hot seat still right now. Expect more any minute.

I went back to the summary of the autopsy, and I had missed this, but Sassy pointed it out. 29 post-mortem stab wounds, but no mention of any difference in the depth or type of cut. I earlier said I thought Joe did it, and no one's chimed in, but reading this, I give higher marks to Harlo, the post-mortem cuts seem more like that of someone who isn't sure the guy is dead and keeps stabbing. Course the comment of the other poster seems equally true, rage after the fact, a deep abiding rage.
I'm out of my depth here. but i'm sure of this, no one new to the scene made the 29 post-mortem stabs, either they were both there and participated, or one did it and the other showed up.

that's as far as i can tell.

ironic, the one time joe wants to keep his mouth shut, today. :)

autopsy summary follows:

Dr. Consalvo also testified that the victim’s windpipe was completely severed as was his esophagus. Furthermore, the victim’s carotid artery, one of the main arteries from the heart to the brain, was severed. This was determined to be the probable cause of death. Twenty-nine (29) post-mortem stab wounds were also present.

Re update 8, all I can figure is maybe the defense wanted to show that Kocis wasn't as reclusive and paranoid as has been portrayed, inviting a stranger he met online to his house for a rendezvous? Maybe to show it wouldn't have been so impossible for him to have opened the door for Joe? I'm grasping at straws, just like the defense.

Harlow needs to detail his background and tell about the absence of a masculine figure in his life. That is why he sought the life of a homosexual--it is called cannibal compulsion. The defense needs experts to testify.

It's too late for any sort of insanity defense. You have to declare those, way in advance of trial.

This case is just too rich. I honestly can't -believe- the turn of events today. I couldn't write it any better. My laughter is so loud and deep I'm scaring the dogs downstairs.

They don't follow the (tapes) recorded Evidence either. Looks to me like the whole truth has yet to be told.
