Deal or No Deal


Rather than speculate about rumors of an upcoming plea deal, or educate on the overwhelming prevalence of them in our criminal justice system, or make a failed hoax attempt about a deal implicating cooperating witnesses, I’ve decided to take a more cultured, sophisticated approach to this whole deal deal:

Lets make a game show out of it!

Everyone who want to play submit an entry: WHO will make the first deal, WHEN will this deal be announced, and WHAT will the terms be?

So, each eligible entry must contain 3 guesses:

1. Harlow or Joe?
2. Month deal will be announced in the media? And
3. The maximum sentence agreed to under the deal, in years (or “life” for life)?

Everyone who gets all three correct is a winner! If no one hits all three, the winner is chosen amongst those who hit 1 and 2 above, and got closest in sentencing years. Life = infinity (so is not a good choice for tie-breaking purposes).

If no one gets 1 and 2, or if there is NO DEAL…no one wins.

The prize? That coin of the realm here in the Kocisphere…bragging rights!

I know a boring guess but I believe that is the best Harlow can get with the evidence they have.

December is a hope based on Discovery coming to an end BUT a deal may not come thru till trial.

Since Harlow seems to feel their actions were "justified" (San Diego) he may want a trial just to watch the show and see how "sympathetic" the jury seems. I was on a murder case that plead out as we went into the jury room.

As with most pleas when there's more than one person involved... Harlow will follow shortly with the same conviction.

I don't see either getting the death penalty, nor will they take it as far as trial.

But PC don't you need a credible witness to take a plea?
Joe is certifiable,,seriously I know someone who talked with him recently and said he was CRAZY!

Unless he is just PLAYING Crazy for effect.

Which means he could take a plea and then be found unsuitable as a witness leaving Harlow alone to face prosecution which would then motivate Harlow to plea.

Yep don't think we will have a trial,,,

Joe has issues with his temper totally uncontrollable would that be "diminished defense"

Remember the "Twinkie" defense in SF

I'm not certain either of them will plead out early. Perhaps after the worse evidence (previously gathered) is rolled out in court if at all.

I'm not sure if the prosecution is now certain who did the stabbing and planning. Or if the prosecution thinks of them both as very equally guilty regardless. No sweet nice guy following his mean lover from their pov.

And from the evidence gathered the prosecution might likely feel that they don't need Harlow to testify against Joe, they have them both air tight.

This leads me to thing that they would both be offered a deal at the same time, and it might even be the same deal. Life/no parole, not a very good deal. The DA has the upper hand here even if Harlow and Joe have not yet come to that conclusion themselves.

Harlow and Joe with any hope of ever getting out I would think would pass on that deal and go to trial.

The thinking we've seen so far from H/J points to not the most rational thinking. So I expect a trial. Harlow has said that he looks forward to telling (his version of) the truth at trial. Perhaps for once in Harlow's life he is not lying (about going to trial), and since he feels in his heart of hearts that he was "only" an accomplice (regardless of how the state of PA defines the act of premeditated first degree murder, conspiracy to commit murder, and murder for financial gain).

I think we might have a trial after all.... however short.

At this point Harlow with all his dramatic blogging, and the entire mini-circus that has formed must think that the whole world is watching, and with that in mind will want to put on a good show and roll the dice in a trial.

Joe seems to be a fighter and does not give in too easy. He shows no remorse, and no signs of seeing the writing on the wall in front of him.

So if either of them take a deal it would be at some point later after trial has begun. I think they will want to make Sean and Grant appear, and make a production of their last chapter in public. So a trial would be something both of these guys would not want to miss for anything. Last chance to be photographed looking good and all.

3. 25 years to Life with parole

Harlow has information the Commonwealth wants. He also comes across as the more reasonable of the two grifters.

January because Harlow is in effect without counsel because of a seeming conflict of interest in the Public Defender's Office with two of the attorneys representing Harlow who just happened to represent the victim, Bryan Kocis.

If Harlow elocutes, his information pans out in a clean conviction of Kerekes, and he has not misrepresented anything material to the case, 25 years to life with parole is a big possibility. This presumes he did not have an active, direct role in the actual killing of Kocis.

most of us think Joe did the actual deed. he'll get life without parole.

i also believe two others will eventually be charged in this case.

Technically that the same guess as Geoff, bb...so to be an official winner you'll have to post a slightly different combo since he was first with it. :-)
