Back to the Musings

10. [Part 8: The Visit]

The BBTs are fatal to Harlow's claims of innocence. Harlow does not say he actually killed Kocis (in fact, it's probable that Joe did the actual slicing and dicing), but he does unmistakenly place himself in the house with a live, talking, breathing Kocis, in a very much not-on-fire house (in contradiction to Joe's jailhouse interview).

In Part 8, we have Harlow further adding to the "Show Me" list...this is the list of details about Kocis and his home that Harlow talks about on the BBTs, that I CHALLENGE the Harlowites to show me could have come from any other source than Harlow being at the scene, chatting with a live Bryan prior to the murder. To the list we now add the location of Bryan's Masarati and Aston Martin:

SEAN LOCKHART: What happened to his car?




HARLOW CUADRA: Ah, nothing...




JOSEPH KEREKES: The Mazaradi? It was at the shop.




HARLOW CUADRA: He told me, ah, the Austin Martin was in fucking Delaware or something...

...the fact that Bryan did not own his new Aston Martin, but leased it instead:

SEAN LOCKHART: He had two cars?




GRANT ROY: Yea, I told you he bought an Austin Martin.




SEAN LOCKHART: I didn't know that he had...




JOSEPH KEREKES: It was a lease he said to Harlow.



...as well as the cost and description of Bryan's two-day old Sony 65 inch plasma screen TV and entertainment center:

JOSEPH KEREKES: Oh tell him about the brand new, he just got it in two days ago, sixty-five inch plasma TV...



HARLOW CUADRA: Yea, a Sony...




JOSEPH KEREKES: He said a twenty thousand dollar sound system.




HARLOW CUADRA: It was all there.




JOSEPH KEREKES: Right there behind the...




HARLOW CUADRA: It must look like shit by the time what's his name was done, but yea. He was trying to figure it out, how to operate it while I was there, on the phone with Lee. I'll tell ya what, Lee sounded so happy and so confident, I could hear his voice as clear as day, like...
Now, I am going to go ahead and actually remove (yes, remove) one item from the "Show Me" list, and that is the description of Bryan's door. It's conceivable under the fantasy scenario outlined in Joe's jailhouse interview that Harlow could claim to have memorized what the door looked like, just before he smelled smoke and ran away (yeah, I know, LOL), so, being the fair-minded soul that I am, off the list it goes. But adding the three items above, the list still grows by two:

4. Bryan planning to buy a San Diego condo;

7. Bryan's Adobe editing software;
8. Location of Bryan's cars at the time of the murder;
9. Bryan's lease (not purchase) of an Aston Martin;
10. Price and description of Bryan's new home entertainment center

Once again, the Harlowites claim that stuff Harlow said on the BBTs can be explained by Harlow previously reading about the details on blogs or in news accounts; with this list, I CHALLENGE them to show me the public sources Harlow could have gotten these details from...or, by their silence to this challenge, admit they are WRONG.

A couple more related musings: The location of the Masarati after the murder was, for the longest time, a particularly deep mystery. The news accounts mentioned only that it was not at the residence. The early blogging over at Jason Curious was then wildly speculative over it's location, with probably the most active speculator back then being Elm, as I recall. Find the person who knows where that Masarati is, Elm would theorize...and you will have found the murderer!

Well by gumby, it looks like Elm was exactly right. :-)

Final musing on this section (and it's a big one): When Joe says "Right there behind the..." he pretty much betrays the fact that he was in the Kocis home too; a big slip-up by Joe. He manages to catch himself in mid-sentence, and then if you notice Harlow tries to come to his rescue, immediately bringing up the imaginary third man ("what's his name") who I guess they are trying to convince to Sean and Grant did the killing at their behest.

Regarding "whats his name:" My theory on this so-called "third man" has always been that Harlow and Joe were trying to sound more impressive to Sean and Grant, by saying they had a Luca Brazi at their disposal, who they could call on whenever they wanted to "push a button" on someone. This illusion of mafioso-like influence would have been shattered if they admitted the truth, that it was merely Joe who stormed through the door and killed Kocis. If you recall, this illusion goes back to the Vegas lamb dinner as well (ie, the friend of Harlow who sends people to Canada).

I don't think anyone seriously believes in the "third man" theory anymore.

Your list of irrefutable facts is extensive. These are the facts that must be addressed if Harlowites wish to be taken seriously.

The whereabouts of the Maserati are problematic. I was not the only commentor to note that the Maserati was seen in Kocis' garage and was not damaged in the fire. The business with the Austin Martin may mean that that car is undergoing routine maintenance per the leasing agreement and is in the shop.

Not to quibble but some of the facts I believe were being purposely convoluted by Joe and Harlow to confuse and confound Sean and Grant. If you notice, the BBT's are 2/3's directed to Grant. For example, when Sean attempts to interject details into the conversation Joe, and sometimes, Harlow will talk over Sean's input. Joe very clearly knows that he must impress Grant if Norfolk Escorts/Boybatter is going to have any chance of gaining a deal with LSG, LLC.

The fact that even Harlow and Joe seem to be treating Sean as a commodity, not a person, comes through loud and clear. Obviously, they need Sean's services, in their view, to keep their budding empire afloat.

I think Grant testified at the prelim that he heard them say the Masarati was in the "garage." Of course, Grant was going off his memory here, and was allowed to only glance at the BBT transcripts to occasionally jog his memory.

Was Grant's memory faulty on this minor detail? Or, by "garage" did he mean "repair garage?"

In any case, we should go by what the BBTs say, I think. A recording or a transcript does not forget.

Agreed on Grant's PH testimony. The point with the Maserati becomes one way to nail down Joe's presence. If Joe made a statement about the definite location of that car, his alibi of sitting on his duff at the Fox Ridge Inn, goes up in the sizzle and crackle of the electric fire.

There is major league bragging going on at Black's Beach and wading through the obsfucation takes tremendous patience for certain. The one intriguing detail that will remain a mystery until the trial would be the identity of the last caller at 7:50 p.m. EDT. Why should Kerekes erupt in a fury at that particular call/caller? Did that person ID his/herself? Now that is a question worth pondering. Considering the discussions on the phone concerned turning Sean into a model/actor/in-call escort.

In light of the Black Beach's Transcripts being made available, this quote "Basically just an apartment for Brent, a big dick for Brent's hole in private and someone to hold the camera," which appeared on Jason Curious' post at the time of the murder in 2007. At the time a derogatory, degrading comment about Sean. In light of the BBT's far more sinister. As relayed from the BBT's, in light of the overheard by Harlow conversations Kocis was having with Lee Bergeron and others on the phone regarding the purchase of a condo/apartment for Sean who would be using this abode as a studio/in-call escorting pad/love nest when Kocis was in town (assuming Grant Roy was out of the picture as planned in the collusion with Kocis lawyer Sean Macias) the quoted passage is most chilling.

You will note the author describes Sean as a commodity, not a person. Not a wit of concern for Sean's well-being, just business, which is a function of Robert Wagner, procurring, as he demonstrated in the Summer of 2004 when Sean lived with Kocis for the month of July as reported in the RS and Out articles, alluded to in Sean's Siren's Tale and Sean's BCO blog. It is both the RS and Out articles that detail the 3-somes Sean was given GHB laced bananna flavored schnapps as preparation to participate in and, by inference, filmed.

I find it telling that that very same blogger wrote, "[The police] also need to find out what was on the "master disks" stolen from Kocis' house . . . ." I took flack for mentioning those stolen 55 master disks. I don't believe all 55 master disks were destroyed. Those disks would make interesting leverage. For example, the one containing outtake material from School Boy Crush and a discussion between Sean and Brent Everett is suggestively hinted at being retained by Harlow and Joe. Harlow teases that he recalls the outtake conversation verbatium. Somehow those master disks are a worry for the content they contain and the personalities on the disks. A BB persona also wrote "[Kocis' murder] could also be about who gets to keep Brent's love — who gets to tap that sweet, star-tatted ass. Both a sexual and financial contest . . . ," a quote that gets chillingly at the motive the police have stated for this murder--Sean as a sex commodity. With a statement like this last one, one must seriously consider that perhaps RW, in arranging those 3-somes as detailed in the RS and Out articles, lived that dream once or twice himself.

I think the phone records from Brian's account which will show just who called at the times Harlow said they called - will be the tempeture at which this goose is cooked.

If the phone records come back as not showing anything remotely in sync with Harlow's claims (no Lee calls at all), then well... he might have a case that he told a bunch of lies to impress Sean and Grant at the beach. Hello, I fucking lied!

But from what I gathered, Harlow did have a bit of lust for Sean, more than just a slab of business material, but a real hard and horny lusty turn-on fantasy.

This is a lesson in lusting after the wrong person, mixing business and pleasure, and not follwing the advice of a lawyer. Had they not gone to San Diego, and not talked at all about Brian ever again with anyone or themselves, they might have never been arrested.

This was a messy job, that had bad timing at the scene. Did Joe really dial 911 as they were driving away from the burning house? But anyway, it was a messy "Fargo" style staging. But they might have been clean and away had they not talked to anyone and just had attorneys answer questions.

But here we are, H & J in jail (must feel like they have already done 5 years by now).

Yep. I think it will probably come to pass that the Lee call did occur. As I noted in my earlier post, the fact that Harlow mentions a condo/apt, and then Brent confirms he did indeed get offered a condo/apt...that is just too spooky a coincidence to ignore.

All seriousness though, yes it must be horrible - for everybody.
The daily phone calls from prison,
H&J, not being able to say anything but "when am I going to get out of here", This is what I need, and what is being done to help me, etc.
You never really getting any clear picture of what really happened and never will, IMO [I am talking about the family members and friends].
dewayne mentioned life for Joe and 15 - 25 for Harlow. Personally I agree with that wholeheartedly.

I wrote "The whereabouts of the Maserati are problematic." Not so much. I went back to the Preliminary Hearing testimony. The relevant portion concerns the Day 2 testimony of Grant Roy. Grant Roy's Preliminary Hearing testimony states "Kerekes admitted seeing the victim's 65-inch TV and [Kocis'] Maserati in the garage," (PHT,Day 2). I do believe that the confusion over whether the Maserati was in the shop (for maintenance) or parked in Kocis' garage is put to rest. Grant says Kerekes SAW the Maserati in Kocis' garage which would not have been possible if that vehicle were off the Kocis' premises. On the other hand, the Austin Martin seemingly is the Kocis' leased automobile that is in the shop and off premises for routine maintenance per Kocis' lease agreement.

Because, if it's in the Day Two transcripts, I don't see it...
