Miscellaneous Musings on the Blacks Beach Tapes

...by me will be gathered and posted right here, as soon as all are posted on PC's blog, and I've had a day or so to fully reflect on them.

And here we go! I think what I'm going to do is just re-read through the whole transcript, and "live-blog" my re-reading, making note of an commenting on those parts that in particular catch my eye.

1. [Part 1: Getting Ready]

GRANT ROY: Don't let him say, Sean ya know we did this is... say no, you were just going to take care of the escorting connection that's why Grant was so fucking mad about this whole fucking thing, he didn't need to die, ya know and that's...

SEAN LOCKHART: I'm, I'm gonna be quiet.

GRANT ROY: No, well, I'm just saying...

SEAN LOCKHART: If they lie, I'm gonna call them out, right?

GRANT ROY: Yea. Ya know, just, that's fine.


This exchange took place before they picked Harlow and Joe up in the car, and you can see the game plan: to NOT let Harlow and Joe get away with implying Sean and Grant knew of the murder beforehand. If they did so in any way, Sean was to immediately "call them out" on the "lie."

As things turned out, this calling out plan was unnecessary...Harlow and Joe never even came close to making any such implication.

Also interesting is what fact Sean was to use to call them out on the potential lie: "...you were just going to take care of the escorting connection..."

As we find out later in the tapes, Bryan had an issue with his porn boys engaging in freelance escort work. Ah...NOW we begin to see one of the major problems with Boybatter partnering with LSG/Cobra under the settlement agreement. It was obviously made clear to Harlow and Joe (at the dinner? or the subsequent bitchy phone call?) that Bryan would never allow freelance escorts into his sphere of operations, and as they could have never parted with their Boisrus operation...they seem to have come to the conclusion (on their own) they had to remove Bryan from the equation in order to succeed in their goals.

2. [Part 1: Getting Ready]

JOSEPH KEREKES: Wow, oh my God, I'm actually scared. I never seen anything like this Grant.

HARLOW CUADRA: (inaudible) oh yea, yea. This must be about twenty stories in the air if you were in a building.

GRANT ROY: Oh at least.

JOSEPH KEREKES: Thirty.




3. [Part 2: The Descent]

A slightly abridged, illustrated version. The danger Sean and Grant were in during this cliff climb with Harlow and Joe is readily apparant (all photos from http://www.blacksbeach.org/)

JOSEPH KEREKES: I'm surprised they haven't set up a walk way or something.

GRANT ROY: Well I don't think that's a good way... I'm gonna go this way.

JOSEPH KEREKES: You alright Harlow?

HARLOW CUADRA: Yea.

JOSEPH KEREKES: This looks like it turns into a waterfall.

GRANT ROY: Just watch the little step places that's where (inaudible).

HARLOW CUADRA: I will never forget this.

GRANT ROY: (inaudible). Careful, that's not a good way.

JOSEPH KEREKES: Baby, remember, if you build up any speed, you're not gonna be able to stop, and you don't wanna get dirty or scratched, alright?

GRANT ROY: Just kinda follow me.

GRANT ROY: Right there, that would be good...

JOSEPH KEREKES: Why did you wear your sandals Harlow?

GRANT ROY: Yea, well I was hoping he told you not to, did he tell you to wear tennis shoes?

HARLOW CUADRA: Brent said, it'd be a good idea if you wore shoes, I was like ah, should I wear sandals, I didn't know that was a warning, Brent.

SEAN LOCKHART: We're half way down there.

GRANT ROY: The hardest part is... watch, get the little places where it's a little solid is where you wanna plant sort of... alright, let's go down right... now come over here.

GRANT ROY: Oh, you go that way, I'll go this way. It's a little more gradual.

JOSEPH KEREKES: And a little steep too.

GRANT ROY: Yea, just kinda, just kinda... there ya go, you got it, that's it...

JOSEPH KEREKES: Oh God, look we're already at the water.








4. [Part 3: Picture Time]

HARLOW CUADRA: Joe's got my name on his ass.

GRANT ROY: Oh really?

JOSEPH KEREKES: Cuadra

GRANT ROY: Really?

JOSEPH KEREKES: Yea, these are the only ones I kept.

GRANT ROY: Oh really?


You know, if Harlow does indeed "roll" on Joe...imagine him waking up every morning in prison, and seeing that tattoo... :-)

5. [Part 4: Web Woes]

JOSEPH KEREKES: We found this ah, Romanian webmaster and I swear it's like slave labor, I feel bad sometimes...

HARLOW CUADRA: I feel bad...

"The Romanian Webmaster was cheap because everything Boybatter had on site has now been sold by that poor slave driven WebWonder!

Yep EVERYTHING Boybatter had on the site was uh copied and "distributed" within a month of Joe and Harlows arrest!

Guess Joe won't be traveling to Romania, I'm sure thats what Vlad the Webmaster laughed!"
Anyways, it appears Vlad is indeed dunzo over there, as Boybatter now has this message prominently displayed on their web site (hat tip to PC for this):



Makes me ponder what they mean, exactly, by "severed all ties with the original owners." Does that mean proceeds from memberships are no longer being donated to the defense efforts? And who is this "new management team" anyways? Their 2257 link is still dead. You know, I wonder if this "new management" is a sham to hide assets from Harlow's creditors? Given the stunts and scams the Harlowites have attempted in the past, I would not put this past them.

Same here Jim I have something to say and the release of the transcript gives me the freedom to do so.

I especially await your take on this,You have been so much the voice of reason this year!

My first quick observation,,,

Harlow comes across more involved in the conspiracy than many thought,,and it seems obvious the murder of Bryan Kocis was a truly joint plan by Joe AND Harlow.

Yet Harlow can seem strangely sympathetic,,Joe is all business and calculating.

Harlow seems to have been that rarity a Murderer with a conscience,,,

Go Figure!

Your opinions are greatly anticipated.

It is clear there was no night in/on the sack with any john by Harlow.

It is clear there was no mid-winter's PA camping trip with a side excursion to the local Luzerne County Wal-mart to "pick up camping supplies." Since this issue was dealt with back last summer (2007) I cannot help but wonder why this revelation was presented now because well it just plain seems highly contrived.

Lastly, Harlow clearly did not stumble/bumble onto an already dead Kocis unless that man's corpse momentarily reanimated and talked to Harlow and others and otherwise interacted with one half of the grifting, premeditated murdering, con jobs.

I do have a question for you. I smell the attempt of creating a mistrial in light of yesterday's Kerekes' in the courtroom pre-hearing outburst, not to mention confession. And that seems like a perversion of justice.

Well, there can't be a mistrial until there's a trial, period.

But I will say this...Joe's appointed attorneys would be nutzo to take Joe Kerekes' case to trial. They simply have to deal now, and take whatever crumbs Melnick deigns to offer them.

They cannot risk a trial with a defendant prone to emotional (AND incriminating!)
outbursts like this in open court.

I said the same thing when I went there. DeWayne explained. There are actually two problems. This is a sandstone cliff and eroding very quickly. It doesn't rain much in southern California but a little rain on this cliff washes away a lot and softens a lot more. A permanent walkway would very expensive and near impossible to secure.
This portion of the beach belongs to the city. A little north is part of the State Park. If the city maintained such a walkway, it would be legally liable for the safety of the walkway, again very expensive.
The solution is that the city posts signs telling people not to use this trail and volunteers maintain it. If some city money, equipment or supplies goes into the trail maintenance, no one can say.

Jim I looked BlacksBeach.org up a few days ago the route you illustrated goes to the "straight" beach on your pic of the cliffs it is the right side path.

The trail to the "Gay" side is 20% steeper and to the extreme left in the picture (and then goes out of frame) I never use that route down(sometimes on the way back up) Albert and I snapped pix looking down that trail then opted for the Straight trail!

I May take the video cam and record the trip down BUT we have had a lot of rain and its unstable right now, FYI they just closed two buildings at UCSD today because the cliff is now 10' from their foundations!

Just a comment about Harlow and Joe's reaction to the cliffs when I was a teenager I had severe Vertigo which I seemed to "grow out of" so I know if you have a fear of heights or Vertigo you will not go near those cliffs!

WOW! I just have to say that PC has demonstrated what REAL journalist work looks like! Many high5's to PC not only for the dedication to this story, but to bringing it back under control and managed in a responsible way.

I was interested in this story from the get go. But the madness that was occurring on the other blogs that were so called covering it turned me away. Way too much mis & dis information to digest and sort out.

Now, to re vest and to "catch up" would be like tuning into "Survivor "with just a few episodes left and try to fully understand what actually happened from the start.

Pc, however, has made this now possible.

Brilliant work and dedication PC! Simply outstanding!

What's up next? The KM murder mystery? lol j/k!

A $99 special incentive promotion? That won't create Net Cash Flow. Any reasonable, potential customer would blink twice at that price because no new video will be produced unless covert jailhouse video will make its way to the marketplace which is highly doubtful. I keep thinking auction scheme; tee shirts for the Free Harlow and Joe movement; probably, at first, escorts soliciting tricks for this same cause.

On a more serious note regarding evidence admissable at trial. Certain pro-Harlowites have been trying to portray the Black's Beach Confessions and Conversations as not worthy evidence. On the contrary, We were lead to believe that the beach confessions were hearsay. Well in American law, yes; however, it is given an exception to the hearsay rule in criminal practice and procedure. The fact that an accused person/suspect has confessed guilt regarding a crime supports conviction despite denials or silence of the accused at trial--the classic hearsay exception which is another Elm tall tale shot down regarding the admissability of evidence and its place in a jury trial.

Then, evidentiary procedure regarding witnesses. In this case, three are critical--Sean Lockhart, Grant Roy, Robert Wagner--they are parties with knowledge relevant to the crime being prosecuted and will testify if this case does go to trial. Grant Roy was called to testify at the Preliminary Hearing, and speculation swirled as to why Sean was not called. Grant was called because he was the state's witness who participated in approximately three quarters of the Black's Beach conversations. He elicited the majority of the comments from Harlow Cuadra and Joe Kerekes; hence, it made good sense for the prosecution to use Grant's testimony to bind the defendants over for trial.

Most clearly, Grant and Sean will be testifying under oath at trial, unless the accused plead out; however, in doing so either or both defendants will be compelled to elocute what happened on the night of 24 Jan. 2007, at Bryan Kocis' PA residence. Sean and Grant will be testifying as to their own knowledge and will be required to express facts only, not opinions.
